Fresno divorce attorneys at the law Offices of Jeffrey D. Bohn were successful in obtaining a five year retaining order in a contested trial on September 24, 2008 in Fresno County Superior Court. In the event of domestic violence, your first resource is to contact your local police and request an emergency protective order. This is an order that must be approved by a judge before it can issue. You can then seek a Temporary Restraining Order (TRO) by filing a formal application with the family court in your county. If the court finds that there is a sufficient allegation of abuse to warrant a temporary restraining order, the temporary restraining order will issue and a court date will be set for the parties to appear and for the restrained party to object to the issuance of the order. If the restrained order believes that he or she is being wrongfully accused, he must file an objection with the court. In cases where no agreement between the parties can be made, the court will set the case for trial.

There is no filing fee for a restraining order and a prevailing party is entitled to attorney fees at the discretion of the court. If you have any further questions regarding any divorce or family law issues, feel free to contact the law offices of Jeffrey D. Bohn, Fresno divorce attorneys who are experienced with the issues of restraining orders and all other family law proceedings.

FRESNO PERSONAL INJURY ATTORNEYS: TIPS

Many times it is only after an accident that you realize the mistakes you made that compromise your injury claim. Here are some tips for before and after an injury auto accident that will help to make sure that your rights are preserved. Remember, insurance companies are in existence to make a profit. The less they pay out in claims, the more money is added to their bottom line. Even your insurance company will first protect their financial interest before they will write you a check for your valid and justified claim.

TIPS BEFORE AN AUTO ACCIDENT

Make sure you have sufficient coverage: Assume that the other party is uninsured. Never waive the uninsured motorist coverage. An extended stay in the hospital can cost several hundred thousand. At a minimum, insure yourself with $100,000/$300,000 coverage. (That means $100,000 maximum per person and $300,000 maximum coverage per accident.)

Add Medpay to your policy, minimum $10,000: The average trip to the hospital combined with an ambulance ride is $10,000-$15,000. Medpay is a no-fault type of insurance and will be immediately available to pay any medical expenses.

Purchase a disposable camera to keep in your glove box. This will come in handy for more than taking pictures of your auto accident. Also, pictures taken with film have a much higher resolution than those taken with a cell phone.

Remember, if you loan your car to a friend, you are liable personally for any accident they cause. If you don’t have sufficient coverage, you could expose your personal assets to a claim by an injured party.

TIPS AFTER AN AUTO ACCIDENT

Make sure you get any witnesses’ contact information. Following an accident, a guilty party may have selective memory, or recreate the accident so that the blame is placed on you. If you have passengers, speak to the other party in their presence and discuss the fact that the other party is at fault. If they admit their fault in the presence of your passenger, they will have a tough time trying to change their story later.

Take pictures of the vehicles and scene of the accident and of your injuries. Bruises and cuts fade and it will be impossible to prove the full extent of your injuries if you fail to take current pictures of your injuries.

If a police report is made, make sure the investigating officer hears your version of the facts.

Always retain an attorney. Insurance companies will never give an unretained person the same settlement that they will one who is has retained a practiced trial attorney. Never use an out of town attorney. These “as seen on T.V.” attorneys simply take your case to make a quick settlement that is far less than you can get if you hire a practiced local personal injury attorney. If they can’t get a quick settlement, they refer it out to a local attorney to get a referral commission. You are just a number to them and they will try to settle your case and almost never be willing to take your case to trial. Insurance companies know which attorneys are “settlers” and which are “trial attorneys”. The potential recovery you will receive will always be bigger with a competent local trial attorney.

Report the accident to your insurance company and the DMV as required by law.

Don’t EVER give a recorded statement until your attorney is present. The purpose of either insurance company taking a recorded statement is to try to avoid paying a claim. Their questions are scripted to elicit an admission that you are fully or partially at fault or that you were not injured so that they save money. The good hands they profess to have are used to keep all your insurance premiums and are loathe to let a few coins fall to their insureds.

Seek necessary medical attention within 3-4 days minimum. If you try to tough it out, insurance companies will interpret your refusal to seek medical attention as an admission that you were not injured. Unfortunately, several months later you may discover that that your nagging injury will not go away. Many people do not feel pain directly after an accident because they have an adrenaline rush, which is the body’s “fight or flight” response. Most people don’t feel the full effects of their personal injuries until the next morning or even several days later. If you postpone seeking out medical treatment, this will be interpreted by the insurance companies as your fraudulent attempt to get an undeserved payday from a non-existent injury.

Even if you suffer only a soft-tissue injury, you may need to seek out a medical doctor in addition to your chiropractor. Pay attention to your how your body responds to chiropractic treatment. If you don’t start to feel a decrease in your symptoms after a few weeks of treatment, schedule an appointment with your family doctor to see if your injuries may be more serious.

Call us for a free in-person consultation with an attorney. When in doubt, get competent legal advise.

On August 11, 2008 judgment was entered in favor of the plaintiffs in the case of Lee v. Lee. In a case involving issues of disputed ownership of Fresno County Real Estate, Mr. Bohn’s clients were successful in the following causes of action against the defendants:

Quiet Title

Slander of Title

Fraud

Cancellation of Instrument

Constructive Trust

The case of Lee v. Lee was presided over by the honorable Adolfo Corona. This dispute involved complex claims to real property including over 20 deeds to properties some of which were determined to be fraudulent. Mr. Bohn, a Fresno real estate attorney, focuses his practice on all areas involving complex litigation issues. Having been a realtor and real estate investor since 1994, he understands both the abstract legal issues surrounding real estate practice combined with the actual business practices of real estate professionals on the street. It is with this expertise that he was able to achieve a successful verdict for his clients.

The recent arrests of 16 suspected undocumented workers at a Loveland, Colorado concrete plant show that ICE (Immigration and Customs Enforcement) officers continue to aggressively pursue their policy to deport undocumented workers with no previous criminal records. This policy underscores the urgent need for immigration reform which will allow hard-working immigrants the chance to earn legal status. There are legal avenues for undocumented workers to gain legal permanent resident status even if they initially came to the United States illegally. In some circumstances, if your children are U.S. citizens and you have an extreme hardship, we can help you to gain legal status. For more information call me to discuss the particulars of your case.

May 2008: Jeffrey D. Bohn, real estate attorney, achieved a successful verdict for his client in the recent trial entitled, Gaston vs. Lo, in Fresno County Superior Court. In this case, the court found for the plaintiff, holding that defendant Joanne Myyer Lo filed a fraudulent deed conveying the property in question to her daughter, Douachong Diane Lo after she had previously sold the property to the Plaintiffs seven years earlier. The court ruled that the Ms. Lo filed was fraudulent and that was ruled “cancelled”. Ownership of the property in question was restored to the Plaintiffs: Sally Vang Gaston and Chow Mai Vang.

If you are currently seeking foreclosure help in the Fresno area, there are several ways that we can help you. First, it is not in the best interest of the mortgage companies to add another foreclosure to their portfolios, therefore they are interested in potentially working you out of your financial troubles. We were recently able to negotiate the rehabilitation of a client’s mortgage who was 5 days short of the foreclosure sale. For another client who was five months late in her mortgage payment, we sucessfully negotiated to have the lender add the late payment balance to the principal balance AND reduce the interest rate. Remember, just because you are in foreclosure does not mean that all is lost. There are other remedies that we can use to prevent or minimize the credit damage you will suffer when you go through a foreclosure. Call for an appointment and I would be happy to consult with you regarding your individual options.

And Save Yourself a Lot of Pain!

Call (559) 485-1212 for a free consultation regarding your personal injury case.
We are Fresno personal injury lawyers who care about you and want to fight for you!

After being injured in an accident it is very important that you talk to a personal injury attorney so that you don’t make a mistake that could injure your case. For example, you should NEVER speak to an insurance company representative without having an attorney present. It is their goal to find any grounds to deny your claim or minimize your injury and their list of questions are specifically geared to get information that will ultimately benefit their defense of your case.

Insurance companies will regularly send a “release of confidential information” document and ask you to sign all your privacy rights away. This is a big mistake. This opens the door for them to look into your medical history and find anything that could reduce the seriousness of your claim. Remember, insurance adjusters are graded on their ability to settle claims for the lowest amount possible. This is how insurance companies determine promotion. Unfortunately many people who have been injured in an accident innocently believe that the insurance adjusters will be fair in settling their claim. It’s only after they get put through the ringer that they realize their mistake and seek a personal injury attorney. Sometimes they have already done irreparable damage to their case. Don’t make that mistake. Call a Fresno personal injury attorney at the law offices of Jeffrey D. Bohn today and protect your rights.
